Terms of Service

These Terms of Service ("Terms") govern your access to and use of Gatherly (the "Service"), operated by Gatherly ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Gatherly provides an AI assistant that helps you manage email, calendar, knowledge, and marketing across connected services such as Google and Microsoft. Features and connected-service access are described in our Privacy Policy.

2. Accounts

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for activity that occurs under your account and within your organisation.

3. Free trial

New accounts include a 14-day free trial of our Advanced plan. No payment method is required and you will not be charged during or after the trial. When the trial ends, your account automatically moves to the Free plan unless you choose to purchase a subscription. Nothing converts to a paid plan without your explicit purchase.

4. Subscriptions and billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. Prices are shown in NZD unless stated otherwise. Except where required by law, payments are non-refundable. You can manage or cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to use the Service to:

  • break any law or infringe the rights of others;
  • send spam or unsolicited communications;
  • attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service;
  • upload content you do not have the right to use.

6. Your content

You retain ownership of the content and data you provide. You grant us the limited rights needed to operate the Service for you. We handle your data as described in our Privacy Policy.

7. Third-party services

The Service integrates with third-party services you choose to connect. Your use of those services is governed by their own terms, and we are not responsible for them.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. AI-generated output may contain errors; you are responsible for reviewing it before relying on or sending it.

9. Limitation of liability

To the maximum extent permitted by law, Gatherly will not be liable for any indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms.

11. Changes

We may update these Terms from time to time; material changes are reflected by the "Last updated" date above.
